I forgot about this and unfortunately I have to put this on hold. Due to an unreasonable lying neighbor on the village council, a building inspector who abuses his position, and a massive amount of money being spent in an attempt to deal with malicious prosecution in a court where the judge accepts whatever the village states as fact while refusing to listen to information presented in our defence I have no choice. We have been dealing with the abusive selective enforcement for years and this year we’re again being prosecuted to ‘make an example of us’ by dragging us into court for minor ‘deficiencies’ ignored on other properties. It’s truly disturbing that they have so much influence over the court. The judge ordeded that we have work done by an ‘approved contractor’ on the village’s list. The village officials won’t give us a copy. We were ordered to have one specific person to clean aluminum oxide stains from the house’s brick. $1500 for power washing. A $1640 ‘roof tune-up’ to replace shingles missing tabs became a $4200 charge after the work was done, another $800 for materials to repair the garage roof… and we can’t even sell and move without a presale inspection by the very same building inspector. Their demands are bleeding us dry.

The worst of this year’s confrontation: We had a very wet spring, tied for third most days of rain on record. One of the village’s complaints was we didn’t paint the exterior of my mother’s house in April when they demanded we do so. Even under the best circumstances painting asbestos reinforced siding is a challenge requiring careful preparation. Rain nearly every day and temperatures in the 30s and 40s (fahrenheit) was not an acceptable reason not to comply. In court the judge ordered that the painting already in progress be completed by a contractor on the village’s ‘approved contractor list’ and while looking directly at me said “and NOT YOU”.

The most disturbing ‘deficiency’ cited previously was the 100+ year old barn was ‘out of plumb horizontally with the property line’. The solution demanded? ‘Tear down and rebuild’.

I think demanding that the owner of the fence leaning against the barn repair the fence would have made more sense but then I’m no expert.

It was an attempt to explain my absence in addition to an explanation of the postponement. In simplest terms, the building inspector has been citing us for ‘violations’ with no supporting ordinances for almost 30 years. Several years ago he dragged me into court for ‘violations’ corrected within the specified period and thanks to this same judge I received 1 year of probation with 30 months in jail and $5000 in fines suspended. This was later changed to 3 years probation without my involvement. I reside in the property, but my mother owns it. What’s worse is he’s also cited me for ‘violations’ including the one mentioned previously for the house my mother owns and resides in.
