There is a difference between a “clone” and a “counterfeit”. What you have there is a counterfeit. Instead of trying to sell it (which is probably not legal), you should smash it with a hammer IMO.

Same goes for the fake Mont Blanc watch you have listed.

I'm not so sure. If you look at clothes, the law mostly doesn't allow copyright of clothing design, so it's not intended to give companies protection to be sole seller of their designs. So ok clones of clothing are ok mostly. The law does have something to say about trademark, then, the branding (the counterfeiting) but what? If the purpose is not patent-like, copyright-like, if it's not to prevent financial benefit from the design of others, what is it? It's to protect consumers from being fooled into buying something they think has a name a with a quality reputation to uphold, when in fact it doesn't (and there is no quality upholding it). At the same time this protects the brand reputation. But if you tell people it's fake is it still fraud? How much does it still damage the brand reputation? (maybe some via used market sales?) If anything maybe we should be more "morally" worried about protecting actual works, creations, than people's rights to fool their friends(which they do have the right to do). I don't know if the post above was advertised fraudulently though.
