Can I tell you that you are contributing to your problem? You dont mean that Im sure but you are regardless. Its easy, stop asking for the flashlight, they dont have them and thats highly unlikely to be a lie. What you want is a refund, and for them to arrange and pay for return of their goods they sent instead of the item you bought.

Tell them you ordered a flashlight, and they have not sent one. And thats it, dont keep adding words, dont accuse them, or berate them, its foolish to do so. Your English is not great (you get by with English speakers), and it complicates their translation service as they dont speak English well either.

Your error was letting it go past the PayPal deadline. If you explained to Paypal that Gearbest never sent what you purchased, there would be no question about their responsibility to refund, and arrange and pay for the return of their items. In the end, you might be stiff out of luck.

Stick to basic facts, nothing more…
Hi, I did not receive the item I have ordered despite several attempts. I have paid for that item but you have not sent that item and to make matters worse you have sent the wrong items several times now. As you have stated to me that the item I have paid for is no longer in stock I demand a refund of my money. I do not want store credit. As the mistake is yours and not mine, I am happy to return all wrong items delivered provided GearBest pays for that return postage. It is not my mistake, and I can not be expected to pay for it.

Have you tried to talk with the GearBest CS person that responded to this thread?

Yes, you say the true but this I asked long time ago… but allways the same. “If you want the money, you must send us all items and you pay the shipping cost” so What can I do?? I tried…. I prefer the money that the flashlight because I don’t need it now. But always the same, only 2 options: 20$ coupon or I pay the shipping.

And yes, Gearbest Cs sent me a message yesterday ask me by the order number. I gave to him but nothing more, I am waiting the reply.

Have to agree with Ejected Filament. It can be hard to communicate with chinese seller, you never know how good their english is or if your messages are set through a translation service. When talking directly to a chinese seller about a problem I almost always break it up into short & simple sentences. Often I go even more simple than Ejected Filament.

Yes, you have not helped the problem very much. Many people just make it worse. Many people are used to buying retail and buying local. They expect this China buying to be the same. It’s not gearbest. It’s all of the sellers. Just look back in the forums over the years and you see the same for just about every single seller that has ever been here. It’s been said over and over again. It’s old news. If you buy from China, then buyer beware. Simple as that. You may have a good experience or you may have a bad one. but Always use PayPal’s protection to make sure you get a refund. If you do not do that, then don’t berate the seller when you go past the paypal time limit.

Sorry, that is the way it is and this whole thing has been done before so many times. A little searching would have shown you many threads berating many sellers already, with no resolution to most all of the problems.

Also, many people, including me, will say how bad a seller is, but if the price is right, we all will still buy from them. That is also the way it is and always has been.

of course, I should to opened a dispute but they said me that “ok no problem, we send to you the headlamp. We are sorry for the incovenient…” so…I decided no opened a dispute for that but I waited 1 month more for this second package and time finished. I have bought online for years, specially Ebay and never I had problem. This is my first problem. I was a virgin :party:

at the german paypal you have 180 days for a dispute. check your paypal, if its the same for you

Paypa only quite recently extended their coverage from 45 days to 180 days I believe.

If he ordered last year, then this new policy might not have been active yet.

I have had problems a couple of times with stuff missing when buying from China - but after notifying - being told to send pic - they have always solved the problem - after 30 plus 30 days or so I end up a reasonably happy customer reasoning if the price is right and time is not a concern I continue buying from China.
