How is it still a laser? it emits non coherent light?

Edit: seams like it depends on the definition of the regulation.
It uses Laser like a CD player. but the light its emitting is not laser.

The court of law seems to be ambiguous on these things. Even if it were an accidental sweep on an aircraft (i.e. an unmanned police drone), an overzealous prosecutor may try to claim something along the lines of the base technology classifies it as a laser. They already do it with other things. Better safe than sorry.

I’d be willing to bet this could apply to long-throw LED lights as well. Just like one could potentially get in some trouble to blind drivers on the street…
