actually… a surprising number of legal documents CAN be made at home, and still be perfectly “legal”.

you CAN buy on of those “kit CDs”, that contain all manner of “generic” agreements and legal texts, and wills are popular among them.

Lawyers themselves? Actually USE those same kit CDs, lol… what LAWYERS bring to the table when they prepare documents?

1) lawyers are knowledgeable enough (or should be, lol) to FORSEE many run-of-the-mill “objections” someone CONTESTING the will later on might use, and to put in clauses extra SPECIFICALLY to prevent that.

2) lawyers keep a hard-copy ON FILE for up to 20 years… this is a “fail safe” against all else happening, and further “proof” of a decendent’s (dead person) actual wishes.

3) lawyers are sure to FILE documents properly and with the proper repository… EG, at the court house or with the city hall.

4) every STATE in the united states has its own laws and differences, and furthermore, every COUNTY in every state, has its own “pecularities” and ways of doing things. Theres a REASON why lawyers tend strongly to practice law in a certain county.

if your “agreement” or “will” is fairly run-of-the-mill, and very generic and straightforward? doing a “home will kit” if a good idea, IF and only if, it is properly filed at the courthouse properly.

good examples of will types to do at home?

“my wife gets everything… if my wife is dead, my only son gets everything.”

or

“Bob Smith, my neighbors eldest son? he gets everything.”

or

“all of my three children? each get an equal share of everything.”

BAD types of wills to do at home?

1) bob gets THIS thing, mary gets THAT thing, Davd gets 20% of the house, will gets 75% of my business, and my youngest cousin twice removed gets the remaining 25% interest…

2) “I hate my family, you all ruined most of my life for me, so, i am leaving everything and everything, to MARY the young stripper at the topless bar i like to drink at to forget you all.”

ANYONE can “contest” a will over almost anything… things that make it easier to contest a will?

1) suddenly changing a long standing will, so as to exclude everyone and giving it all to “so and so” who just appeared in your life recently

2) filing a will and dying pretty soon after. Its surprisingly easy to “raise an argument and suspicion” by claiming “dad was on PAIN MEDS the last year, and BOBBY was beating his ear to get everything while pretending to take care of him”

little things everyone always forgets…

1) if you leave stuff to BOBBY your SON… what happens if BOBBY is dead? specify his kids get equal shares of HIS share… you should cover EVERY POSSIBLE CONCLUSION.

2) You have to name an “executor” or an “executrix” (male or female) as the ONE PERSON t carry out your last wishes. ALSO, if you dont say otherwise? this named executor get an automatic percentage of everything.

being a lawyer? is a lot like every other profession… almost anyone CAN do it? but, unless you DO IT FOR A LIVING, theres a lot of little stuff you will miss.

its like being a mechanic? its looks easy to set the timing marks on the timing chain and timing gears on top ed reassembly! Just line up the TWO MARKS on the TWO GEARS so they touh! The manual says so! how can you screw that up??

easy… if its not a new engine? there could be a small amount of “slop” in the whole system… all within “spec”, but… the marks might line up slightly before or slightly after… which way do you account for the slop? flip a coin?

you just have to do some studying and reading to find the answer… and legal paperwork is no different.

a lawyer is NO DIFFERENT than a mechanic you take your car to… if you take your CAR to the mechanic, and leave it ALL UP TO HIM… you are at his MERCY if you dont know what is wrong, dont know what the part costs, nor have an accurate idea of the time and expertise required to change it.

the mechanic is in business to make money, and if you know nothing, you are a plum to be taken advantage of. The mechanic will charge you 2 or 3 times parts cost, and a ungodly hour rate, plus “several more hours” of magic-charge… and if they are nasty? and think you are clueless? will bill you for stuff they didnt even do.

IF, on the other hand? you show up at your mechanic… knowig that the ABS brake light, AND the service VEHICLE light (not the engine light…) are both on, and that the ONLY thing in common to BOTH SYSTEMS is the speed sensors in the front hubs? AND you hand him the NEW HUBS, ad ask him “how much t put these 2 hubs on? you dont have to separate the struts on my model… its 3 bolts press in…”

he will say “well… 60 per hub… i’ll have it done in an hour.”

“and hey? the torque setting on teh main axle bolt?? i came across a lot of technical service bulletins that are updated to say 175 ft-lbs… not the 235 that the manual always says… that breaks the hubs quick.”

now? your in and out, for a flat charge.

you DONT have to pay for “4 hours of diagnosis” which is often your car SITTING for four hours (for which you pay the hourly service charge for, lol) while the “diagnosis” is actually the mechanics workig on 3 other cars… so the owner gets paid TWICE for the same mechanics labors.

you DONT pay 3 times what the parts actually cost. You GAVE him the parts. They are paid for.

you DEMONSTRATED knowledge of whats going on… he now knows you re NOT going to fall fro the old “well, we had to this and that…” routine to up the bill and overcharge you for un-necessary work if its a “slow” week.

which kind of customer do YOU want to be? the gir that walks in and hands the mechanic a “blank check” to be filled out for any amount he wants?

or… do you want to hand the guy 120 bucks and pick your car up an hour later, and the lights are all off? eh?

lawyers are NO DIFFRENT.
